Terms of Service
These terms cover your use of Park'd Street Eats ("Park'd", "we", "us"). By using the app or website you agree to them.
What Park'd is
Park'd is a marketplace that helps foodies find food trucks and helps truck owners publish where they are, their hours, and their menu. Foodies can place pickup orders and request trucks for events.
Trucks are independent businesses, not Park'd. Every truck on Park'd is an independent contractor that runs its own business. Truck owners are not our employees, agents, partners, or joint venturers, and we don't control how they cook, staff, price, or operate. When you buy food, your contract for that food is with the truck — we are not a party to it.
Payments
Some trucks accept card payment in the app; others take payment at the window.
Where a truck accepts card payment, payments are processed by Stripe and the charge is made by the truck, using the truck's own Stripe account. Park'd may collect a service fee as part of that transaction. We are a technology provider facilitating the payment — the truck is the merchant selling you food, and the truck is responsible for fulfilling your order.
Refunds and order problems are handled by the truck, since the truck holds the funds and prepares the food. Contact the truck first. If you can't reach them, email us and we'll try to help, but we can't guarantee a refund of money we don't hold. Card disputes go through your card issuer as normal.
Catering deposits
For a catering or event booking, the truck sends you a quote and you pay a deposit through Park'd to reserve the date. Like food orders, the deposit is processed by Stripe and charged by the truck; Park'd may keep a commission from it. The remaining balance is paid directly to the truck — we don't handle it and aren't responsible for collecting it.
Paying a deposit reserves your date with that truck. It is not a guarantee that the event will happen: the catering agreement itself — menu, timing, staffing, travel, cancellation — is between you and the truck, and we are not a party to it.
Cancellations and refunds are between you and the truck. Agree the terms with them before you pay. Because the truck receives the deposit, any refund must come from the truck; where a refund is issued, Park'd's commission is returned as part of it. If you can't reach the truck, email us and we'll try to help, but we can't guarantee a refund of money we don't hold.
Truck Pro subscriptions
Truck owners may subscribe to Truck Pro on our website. Truck Pro is billed monthly in advance via Stripe and renews automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the paid period, and partial months aren't refunded. Prices and included features may change with notice, effective from your next billing period. Truck Pro affects placement and features inside Park'd only — it does not imply any endorsement of a truck.
The Verified badge
A ✅ Verified badge means a truck has supplied documents (such as a health department permit, business licence, and proof of liability insurance) and that our team has recorded them as on file and not expired. It is not an inspection, endorsement, or guarantee of a truck's food safety, licensing status, insurance coverage, or quality. We don't independently audit trucks, and documents can lapse or be revoked at any time without our knowledge. Trucks without a badge are not necessarily unlicensed. Use your own judgement, exactly as you would walking up to any truck on the street.
Your account
Keep your login details to yourself, and give us accurate information. You're responsible for what happens under your account. You can delete your account at any time in Account → Delete my account.
Content and conduct
You own what you post (photos, menus, reviews) and you're responsible for it. Don't post anything unlawful, hateful, harassing, deceptive, or that isn't yours to post. Reviews should be honest and based on real experience.
We have zero tolerance for abusive content. Anyone can report a review or block another user from inside the app. We review reports and may remove content or terminate accounts that break these rules.
Truck owners
If you list a truck, keep your information accurate — especially your open/closed status, location, and hours, since that's the whole point of Park'd. Honour orders you accept, or decline them promptly.
You operate an independent business and you alone are responsible for:
- Holding and maintaining every licence, permit, and health department approval required where you operate, and stopping service if any lapses.
- Food safety, preparation, allergen information, storage, and handling.
- Carrying your own insurance, including general liability.
- Your employees, contractors, vehicle, and equipment.
- Your own taxes, including sales tax and any reporting on money you receive.
- Fulfilling orders you accept and honouring your posted prices.
Any documents you upload must be genuine, current, and yours. Uploading a false or altered document is grounds for immediate removal from Park'd.
Indemnity
If you list a truck on Park'd, you agree to indemnify and hold harmless Park'd, its owners, and its team from any claim, loss, liability, fine, or expense (including reasonable legal fees) arising out of: your food or the preparation of it; illness or injury connected to what you sell; your licensing, permits, insurance, or compliance; your employees or vehicle; your taxes; or your breach of these terms. This survives the end of your use of Park'd.
Accuracy
Truck locations, hours, and menus are provided by truck owners. We do our best to keep it live and accurate, but we can't guarantee a truck will be where it says or have what you want. Check before you drive.
Availability
Park'd is provided "as is". We may change, pause, or discontinue features. We're a small team building in public.
Liability
Park'd is a platform for finding trucks and placing orders. We do not cook, handle, inspect, or deliver food. Your relationship for the food itself is with the truck, not with us.
To the fullest extent the law allows, Park'd isn't liable for indirect, incidental, special, or consequential damages arising from your use of the app, from any transaction with a truck, or from food you purchase — including illness, injury, allergic reaction, or a truck not being where or when it said. To the fullest extent the law allows, our total liability for any claim relating to Park'd is limited to the greater of the amount of service fees we actually collected from you in the three months before the claim, or US$100.
Some places don't allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that can't lawfully be limited.
Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida, and you and we consent to that jurisdiction.
Changes to these terms
We may update these terms as Park'd grows. We'll change the "last updated" date above, and for significant changes we'll give notice in the app or by email. Continuing to use Park'd after a change means you accept the updated terms.
